General Release & Agreement

 

When you arrive you will be asked to read and sign this agreement before you can participate in an Equine Facilitated Event.

​General Release​

​

In consideration of my participation with Christine Franklin, "Just Breathe with a Horse", their animals and their affiliates, for a personal/professional Coaching, consultation, seminars, retreats or workshops.  I hereby generally release, waive, discharge and hold harmless Christine Franklin, "Just Breathe with a Horse" and their animals, their agents, employees, assistants, independent contractors and cosponsors and their affiliates, of any liability whatsoever related to my participation with the “Just Breathe with a Horse” event, for a personal / professional Coaching, consultation, coaching session, seminar, retreats or workshop or to learn their training methods as well as any of their affiliates. I execute this release with the express intention of effecting any legal consequences provided by Wisconsin Civil Code, that is, the release of all liability associated with participating with Christine Franklin, "Just Breathe with a Horse", activities, programs, and events. This letter of agreement shall constitute the full and complete understanding between the parties and shall supersede any prior or contemporaneous representations or agreements, oral or written. This agreement shall be interpreted pursuant to and governed by the laws of the State of Wisconsin. If any action at law or equity is brought to enforce any of the terms of this agreement, the prevailing party shall be entitled to actual attorney's fees and costs.   It is agreed that the venue for any such action at law is the City and County of Menomonie, Wisconsin. No assignment of this agreement is permitted and any attempt to assign all or any rights, obligations or duties granted under this agreement shall be null and void.

 

I hereby completely release Christine Franklin, "Just Breathe with a Horse", their animals and their agents, employees, assistants, independent contractors and cosponsors and their affiliates, of any liability whatsoever related to my participation with this event on this or any other day.

 

"A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known to him must have materially affected his settlement with the debtor."

 

“Just Breathe with a Horse” seeks and strives for safety at all times. However, I understand that there are certain risks inherent in equine related activities. I acknowledge that all activities involving horses (included but not limited to: horseback riding, handling, leading, groundwork and other contact) involve this degree of risk.

 

Under Wisconsin law, an equine professional is not liable for any injury or death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Section 895.525, Wisconsin Revised Statutes. In consideration of the services of “Just Breathe with a Horse”, their agents, owners, officers, volunteers, participants and all other persons or entities acting in any capacity on their behalf (herein collectively referred to as “Just Breathe with a Horse”, I agree to waive and release forever all claims for damages against “Just Breathe with a Horse” for any and all injuries and/or losses that could be sustained while participating in “Just Breathe with a Horse”’s program. I further understand that I am not covered by “Just Breathe with a Horse”’s insurance policy.

 

General Acknowledgment

I acknowledge that I have been given the opportunity to ask questions regarding any aspect of the release contained herein, and by signing below, I do acknowledge that I have carefully and completely read and fully understand all aspects of the release and agree to these terms in their entirety. I hereby agree that should any legal proceeding arise relating to this general release and agreement, the disallowance of any term or condition will not prevent the legal enforcement of all other terms and conditions of said agreement. Having been so apprised, I hereby elect to and do assume all of the risk for claims heretofore or hereafter arising known or unknown, from this release and from my participation.

 

Photo Acknowledgement

Client/participant is aware that photos may be taken during the event & used for private promotion of Christine’s website & events and authorizes their use accordingly.

                

 WARNING

 

UNDER WISCONSIN LAW, AN EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES, PURSUANT TO §895.525 and §895.481 & PROVISIONS COMMON TO ACTIONS AND PROCEEDINGS IN ALL COURTS MISCELLANEOUS GENERAL PROVISIONS

 

 

I HEREBY HAVE READ THIS DOCUMENT AND UNDERSTAND IT.  I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
